Triangle Parade of Homes
Terms and conditions
These terms are a binding agreement between you and the operator of the Triangle Parade of Homes companion app and builder dashboard (“we,” “us”). They cover the website, the iOS and Android apps, and the builder dashboard (together, “the service”). By using the service, creating an account, or tapping accept, you agree to these terms and to the privacy policy. If you use the service for a builder or brokerage, you also agree on that organization’s behalf and represent that you have authority to bind it.
If you do not agree, do not use the service. The service is a guide for a housing event. It is not the event organizer, not a real estate broker, and not the seller of any home.
Who may use the service
You must be at least 18 and able to form a contract. The service is not for children. You may not use it if we have suspended you, or if the law where you live bars you from doing so.
The service
Visitors can browse Parade homes, save favorites, plan a tour, record visits on a Parade Passport, keep private notes and photos, and send a request for information to a builder. Builder and realtor staff can manage listings and follow up on those requests. Features may be added, changed, or removed. Store buttons marked “Coming soon” do not install an app.
Home details — including address, price, photos, hours, availability, and builder identity — come from participating builders and other sources. They can be wrong, incomplete, or out of date. A listing is not an offer, a contract, a warranty of condition, or a promise that a home is available, open, or accurately described. Always confirm details on site with the builder, and with your own agent and advisers before you rely on anything you see in the service.
We do not provide real estate, lending, legal, tax, inspection, or appraisal advice. Mortgage figures, if shown, are estimates only. We do not represent buyers or sellers, do not negotiate sales, and are not a party to any transaction between you and a builder, agent, or homeowner.
Accounts
You may browse as a guest. A guest session is still an account on our systems so saves and stamps can stay with that device. If you create an account, the name, email, and other details you give must be accurate, and you must keep your password confidential. You are responsible for everything done under your sign-in, including a guest session on your device, until you tell us it is compromised and we have had a reasonable time to act.
Dashboard access is only for a person whose email is on a builder’s or realtor’s staff roster. We may refuse, suspend, or close any account, and we may remove content, if we believe these terms were broken, the law requires it, or the service or other people are at risk.
Visiting homes
Touring a home is voluntary and happens on property we do not own or control. Builders, owners, and the people on site are responsible for the premises, for who is allowed in, and for what they tell you. You assume the ordinary risks of visiting unfamiliar property, including uneven surfaces, construction conditions, crowds, and travel between homes.
To the fullest extent the law allows, you release us and our contractors from claims arising out of your visit to a home, your travel to or from a home, or your dealings with a builder, realtor, owner, or other visitor. This release does not apply to harm caused by our own gross negligence or willful misconduct, or where the law does not allow a release.
Location and Passport stamps
If you allow location while the app is open, we use it to estimate that you are at a Parade home so a Passport stamp can be recorded and nearby saved homes can be pointed out. We do not ask for always-on background location. Location can be inaccurate. A stamp means our systems thought you were nearby. It is not proof that you entered a home, proof of a purchase, a prize, or anything a builder owes you.
Requests for information
When you send a request for information, you ask us to share that submission — including your name, email, phone number if you provided one, and your message — with the builder responsible for that home and with realtor staff who manage it. They may contact you about that home. You promise the contact details are yours, or that you have permission to share them. Do not send anyone else’s information.
Notes and photos you attach to a visit stay on your account and are not part of that message. Optional feedback about price or size is stored so builders see totals, not your name.
Your content
You keep ownership of content you submit, including notes, photos, messages, and listing materials. You give us a non-exclusive license to host, copy, display, and share that content only as needed to run the service and to do what you asked — for example, showing a listing to visitors or delivering a request to a builder. The license ends when the content is deleted from the service, except for copies we must keep for a legal duty, a backup cycle, or a request you already sent to a builder.
You represent that you have the rights to what you submit, that it is lawful, and that it does not infringe anyone else’s rights. We may remove content without notice. If you believe something on the service infringes a copyright, send a notice that identifies the work, the location of the material, your contact information, and a statement that you are the owner or the owner’s agent. We may not have a registered copyright agent until one is published here.
Builder and realtor staff
If you use the dashboard, you also agree that:
- You will publish only homes you are authorized to show, and only photos, prices, and facts you have the right to use.
- You are responsible for keeping your listings reasonably current and for how your staff responds to buyers.
- You will use a person’s contact details only to follow up on interest in your own homes, and you will not sell, rent, or build a marketing list from them.
- You will comply with the Fair Housing Act, applicable real-estate licensing rules, and telephone and texting rules, including any request to stop contact.
- You will not use the dashboard to view homes, leads, or people belonging to another builder.
- You will follow the privacy policy when you handle buyer information we send you.
You will indemnify us against claims that arise from your listings, your photos, your use of lead information, or your contact with a buyer.
Acceptable use
You will not:
- Break the law, or help someone else break it, through the service.
- Harass, threaten, or discriminate against a builder, visitor, or staff member.
- Scrape, harvest, resell, or misrepresent listings or other people’s information.
- Probe, overload, or bypass the service, or access an account, dashboard, or listing you are not authorized to use.
- Upload malware, or submit content you do not have the right to share.
- Suggest that we endorse you, your brokerage, or a home.
Our intellectual property
The service, including its software, design, and text we wrote, belongs to us or our licensors. These terms do not transfer that ownership. “Parade of Homes” and related event names and logos belong to their owners. You may not copy the service or use our branding except as the service itself allows. Listing content remains the responsibility of the builder who supplied it.
App stores and other companies
If you download the app from Apple, these terms are between you and us, not Apple. Apple is not responsible for the app or for maintenance, support, or product claims. If the app fails to meet a warranty, you may notify Apple, and Apple may refund the purchase price if any was paid. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. You must also comply with the App Store terms.
The same idea applies to Google Play: Google is not responsible for the app. Maps, sign-in, hosting, and email are provided by other companies under their own terms. We are not responsible for those services or for a builder’s independent systems.
Disclaimers
The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, that listings, directions, hours, prices, or stamps are complete or current, or that a check-in will be recorded every time you visit.
Some states do not allow certain warranty disclaimers, so some of the above may not apply to you. You may have rights that cannot be waived.
Limitation of liability
To the fullest extent the law allows, we and our contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or the cost of substitute services, whether or not we were advised of the possibility. Our total liability for any claim arising out of the service or these terms will not exceed the greater of one hundred U.S. dollars or the amount you paid us for the service in the twelve months before the claim.
These limits apply to any theory of liability, including contract, tort, and statute. They do not apply where the law forbids a limit, including liability for our gross negligence or willful misconduct, or for death or personal injury to the extent a cap is not allowed.
Indemnity
You will defend and indemnify us and our contractors against any claim, loss, and reasonable attorney’s fees arising out of your use of the service, your content, your visit to a home, your dealings with a builder or another user, or your breach of these terms, except to the extent the claim is caused by our gross negligence or willful misconduct.
Disputes
These terms are governed by the laws of the State of North Carolina, excluding its conflict-of-law rules. Before filing a claim, you and we will try to resolve the dispute informally for thirty days after written notice. The exclusive venue for any claim that is not resolved informally is the state or federal courts located in Wake County, North Carolina, and you consent to personal jurisdiction there. Court actions are on an individual basis. To the extent the law allows, you and we waive a class action, a class arbitration, and a jury trial.
If you are a consumer, mandatory local law may give you the right to sue in your home courts, and nothing in this section takes that right away where it cannot be waived.
Ending these terms
You may stop using the service at any time. We may suspend or stop providing it, or close your access, as described above. Sections that by their nature should survive — including content licenses already granted for a sent request, disclaimers, releases, liability limits, indemnity, and disputes — survive termination.
Other terms
These terms, together with the privacy policy, are the entire agreement between you and us about the service. If a court holds part of them unenforceable, the rest stays in effect and that part is modified to the minimum extent needed to make it valid. A failure to enforce a provision is not a waiver. You may not assign these terms. We may assign them in connection with a reorganization or a transfer of the service. There are no third-party beneficiaries except Apple as stated above.
Changes
We may update these terms by posting a new version on this page with a new effective date. If you keep using the service after that date, you accept the update. If you do not agree, stop using the service. For a change that materially reduces your rights, we will provide a clearer notice when we have a reasonable way to reach you.
